Terms of Service
Effective upon submission of project inquiry and payment of deposit.
The Engagement
When you engage Driftworks for a project, we will provide a written scope document outlining what we're building, what we're not building, the timeline, and the fixed price. That scope document becomes part of these terms upon your acceptance.
Payment
All projects require a 50% deposit before work begins. The remaining 50% is due within 24 hours of delivery. All payments are processed securely through Stripe. Prices are fixed — no hourly billing, no surprise invoices.
What You Own
Upon receipt of final payment, you own the deployed application and all associated data. Full rights, no strings attached.
Source Code
Source code is not included in standard engagements. Driftworks retains the underlying codebase. If you require source code transfer, a Production Handoff package is available for an additional fee — $500 for Proof of Concept engagements, $1,000 for Working Prototype engagements. This covers cleanup, documentation, and proper handoff to your development team.
What We May Reference
We retain the right to describe the general nature of completed engagements in our portfolio or marketing materials unless you request otherwise in writing. We will never disclose confidential details about your project or business.
Revisions
Each engagement includes one round of revisions within the defined scope. Revision requests outside the original scope will be quoted separately before any work begins.
Out of Scope Work
If you request work outside the agreed scope, we will flag it immediately, provide a separate price and timeline, and get your written approval before proceeding. We never add scope silently.
Cancellation
If you cancel after work has begun, the deposit is non-refundable. If Driftworks is unable to complete an engagement for any reason, we will provide prompt notice and a full refund of all payments received. We will deliver any completed work product in its current state at no obligation to the client.
Delivery & Hosting
We deliver working, deployed software. Delivered means the application is accessible via a live URL and meets the requirements outlined in the scope document. The delivered application will remain hosted and accessible for 90 days following delivery at no additional cost. Extended hosting is available at $29/month thereafter. After 90 days without a hosting agreement in place, the application may be taken offline. Driftworks is not responsible for data loss following termination of hosting.
Limitation of Liability
Driftworks is not liable for indirect, consequential, or incidental damages arising from your use of anything we build. Our total liability is limited to the amount you paid for the engagement.
Governing Law
These terms are governed by the laws of the State of New York.
